Motorized Skateboard Rules and Regulations

Section 24 5. Toy vehicles, motorized skateboards; restrictions and fees. a. Definitions: 1. Toy vehicles include, but are not limited to, roller skates, roller blades, motorized and non-motorized skateboards, coasters, push scooters, toy cars, and similar non-licensed riding toys designed for off road use. 2. A motorized skateboard is a self-propelled device which has either a gas or electric powered motor or engine, a deck on which a person may ride, and at least two (2) wheels in contact with the ground, and which is not otherwise defined by Wyoming State Statute as a "motor vehicle", "motorcycle", "motor-driven cycle" or "pedestrian vehicle". b. It shall be unlawful for any person using or operating a toy vehicle to travel upon any street or roadway within the city, except while crossing the street at a crosswalk or intersection. When crossing the street at a crosswalk or intersection, any person using or operating a toy vehicle shall be granted all of the rights and shall be subject to all of the duties applicable to pedestrians, including but not limited to: 1. using the right half of the sidewalk or crosswalk, 2. obeying all traffic control signs and devices, 3. crossing streets only at marked crosswalks, or if none, only at an intersection, and 4. in locations where no sidewalk is provided, walking the toy vehicle on the left shoulder or as close to the left side of the roadway as possible facing approaching traffic. This section shall not apply upon any street while set aside as a play street by the city, or to operators of toy vehicles in officially authorized parades provided the operator is wearing appropriate safety equipment as required below. Additionally, operators of motorized skateboards shall be permitted to operate the same when traveling on the following two dirt roads in Green River: the unfinished extension of Monroe Ave from East Teton to Stratton Myers Park, and the unfinished extension of Bridger Drive from 1465 Bridger Driv east to Stratton Myers Park. c. Motorized skateboards shall: 1. only be operated during daylight hours, 2. only be operated at speeds that are reasonable and prudent given the sidewalk traffic present, but in no event faster than 20 mph, 3. if powered by an electric motor, be permitted in city parks and on the Green Belt Trail System. Motorized skateboards powered by gasoline fueled engines are strictly prohibited in city parks and on the Green Belt Trail System. 4. not be operated upon private property where it is posted “skateboards prohibited”, and 5. not be mechanically or structurally altered from the original manufacturer’s design, unless said alteration serves solely to reduce the noise produced when at idle or during operation. d. Operators of motorized skateboards shall: 1. be at least eight (8) years of age, 2. always yield the right of way to pedestrians, 3. if under the age of 18 years, wear appropriate safety equipment including but not limited to, closed toed shoes and protective head gear which meets the standards of the American National Standards Institute (ANSI Z90.4, Bicycle Helmet Standard), or other such standard as set by the City of Green River. The protective head gear shall be of a proper fit with the neck or chin strap of the helmet securely fastened, 4. if under the age of twelve (12) years, successfully complete a safety class offered by the City of Green River or its authorized agent, 5. not allow passengers when the motorized skateboard is in motion, 6. not attach themselves or the motorized skateboard to a motor vehicle or other devise when either is in motion, 7. not carry any package, bundle or other article which prevents the operator from keeping both hands on the handlebars, or obstructs his vision, or interferes with the operation of the motorized skateboard, and 8. not use headphones or similar devises during operation. e. Any adult who has direct control over a motorized skateboard and permits it to be operated by a minor, or any parent or guardian who consents to allow a minor to operate a motorized skateboard, shall be responsible for any violations of this section by the minor. f. Violations under this section shall be deemed non-moving violations. Any person violating this section, or in the case of a violation by a minor then their parent or legal guardian, shall be cited into the Green River Municipal Court to answer to the charge, and shall be fined in accordance with the Court’s jurisdictional limits. g. Any police officer issuing a citation for a violation under this section may also, in his discretion, impound the motorized skateboard, which shall then be held until its release is authorized by the city prosecutor. All impound and storage fees must be paid in full prior to the release of the motorized skateboard. Any impounded motorized skateboard not picked up after forty-five (45) days, shall be subject to sale for impound and storage fees incurred. h. Motorcycles, motorized scooters, and other motor driven cycles, as the same are defined by Wyoming State Statute, are not toy vehicles, and their use is not authorized by this section.
